Acceptance of Terms

By using or accessing QR Shark ("Service"), you acknowledge that you have read, understand, and agree to be bound by these Terms of Service ("Agreement"). If you do not agree to these terms, you may not use our Service.

These terms apply to all users of the Service, including individuals and organizations using QR Shark for business purposes. Please also review our Privacy Policy.

Service Description

QR Shark is a QR code generation and management platform that allows users to:

  • Create dynamic QR codes with customizable designs
  • Redirect QR codes to different destinations
  • Track scan analytics and user engagement
  • Manage QR codes through workspaces and folders
  • Set password protection and expiration dates
  • Target users by geographic location and device type

User Responsibilities

As a user of QR Shark, you agree to:

  • Provide accurate and complete account information
  • Maintain the confidentiality of your account credentials
  • Use the Service in compliance with all applicable laws
  • Respect the usage limits of your chosen plan
  • Not share account access with unauthorized parties
  • Promptly update your account information when it changes

Prohibited Uses

You may not use QR Shark QR codes to link to content that:

  • Contains malware, viruses, or harmful code
  • Facilitates phishing, fraud, or deceptive practices
  • Infringes on intellectual property rights
  • Contains pornographic or explicit adult content
  • Promotes violence, hate speech, or illegal activities
  • Violates privacy rights or shares personal information without consent
  • Redirects to other QR code or link shortening services
  • Spams or harasses users
  • Violates any applicable laws or regulations
  • Contains defamatory or libelous content

Service Restrictions

You also agree not to:

  • Use our service for competitive analysis or to build competing products
  • Attempt to reverse engineer, decompile, or extract our technology
  • Exceed usage limits or attempt to circumvent rate limiting
  • Use automated tools to create accounts or generate QR codes at scale without permission
  • Interfere with the security or proper functioning of our service

We reserve the right to suspend or terminate accounts that violate these restrictions.

Account Management

You are responsible for maintaining your account and all activities under your account. We may suspend or terminate accounts that:

  • Violate these terms of service
  • Exceed usage limits without upgrading plans
  • Have outstanding payment obligations
  • Are inactive for extended periods

Upon account termination, you will have 15 days to retrieve your data before it is permanently deleted.

Payment and Subscriptions

Paid plans are billed according to the billing cycle you select (monthly or annually). You agree to:

  • Provide accurate billing information
  • Pay all charges when due
  • Update payment methods as needed
  • Authorize automatic renewal of subscriptions

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods, except where required by law.

Failure to pay may result in service suspension or termination. All payments are processed securely through Stripe.

Service Availability

We strive to maintain high availability for QR code redirects and analytics tracking. However:

  • We do not guarantee 100% uptime for QR code redirects
  • Analytics data may have slight delays in processing
  • We may perform maintenance that temporarily affects service availability
  • QR codes remain functional during most maintenance periods

Content Monitoring and Compliance

While we do not actively monitor QR code destinations, we reserve the right to:

  • Investigate reported violations of these terms
  • Disable QR codes that violate our prohibited uses policy
  • Cooperate with law enforcement when legally required
  • Remove content that poses security risks to our users

Users are solely responsible for ensuring their QR code destinations comply with all applicable laws and regulations.

Intellectual Property and Data Ownership

QR Shark retains all rights to our platform, technology, and branding. You retain ownership of your QR code content and data. By using our service, you grant us permission to:

  • Store and process your QR code data to provide our services
  • Generate aggregated, anonymized analytics for service improvement
  • Display your QR codes within your account dashboard
  • Process scan data to provide analytics insights

We do not claim ownership of your content or use it for purposes beyond providing our QR code services.

Disclaimers and Limitation of Liability

To the maximum extent permitted by law, QR Shark is provided "as is" without warranties of any kind, express or implied.

We specifically disclaim:

  • Guarantees of uninterrupted service availability
  • Responsibility for content accessed through QR codes
  • Liability for analytics accuracy or completeness
  • Warranties regarding the security of destination websites
  • Warranties of merchantability, fitness for a particular purpose, and non-infringement

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages

arising from your use of the Service, including:

  • Loss of business, revenue, or profits from QR code downtime
  • Damages from malicious content accessed through QR codes
  • Data loss or corruption
  • Third-party actions or content
  • Loss of goodwill or reputation

Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

Termination

Either party may terminate this agreement at any time. Termination may occur for:

  • Material breach of these terms
  • Non-payment of fees
  • Insolvency or business closure
  • Violation of prohibited use policies

Upon termination, your access to the Service will cease, and data retention will follow our data retention policy.

Indemnification

You agree to indemnify, defend, and hold harmless QR Shark and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms of Service
  • Your violation of any third-party rights
  • Content you link to through QR codes
  • Your breach of any applicable laws or regulations

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction where QR Shark is registered, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations or other urgent matters.

Changes to Terms

We may update these terms from time to time. Material changes will be communicated through our platform or via email at least 30 days before they take effect. Continued use after changes constitutes acceptance of the updated terms.

If you do not agree to the updated terms, you must stop using the Service and may cancel your account.
